This policy establishes the process for serving, selling, and using alcoholic beverages on property owned, leased, or controlled by KCTCS, and at KCTCS events. The possession and/or consumption of alcoholic beverages on KCTCS property is subject to Kentucky statutes, county and city ordinances, and KCTCS policies and procedures developed in keeping with the law. KCTCS desires to promote responsible consumption according to all applicable laws. Additionally, KCTCS desires to provide an environment for students where alcohol is not made available, alcohol consumption is not encouraged, and further, alcohol education and counseling programs are promoted. This policy applies to all members of the KCTCS community, including faculty, staff, students, and visitors. In order to promote operational efficiency and to provide administrative flexibility within KCTCS, the President delegates this function to the College Chancellor for his/her respective college. Alcoholic Beverages: shall have the same meaning and definition as provided by the laws of the Commonwealth of Kentucky in the Kentucky Revised Statutes. Employee: means any person defined as an employee, including student employees, and shall mean employees acting within the course and scope of employment. Employee shall not mean a volunteer or independent contractor. KCTCS Event: means functions, programs, and other activities that: 1. Occur on KCTCS property; 2. Are sponsored by KCTCS; 3. Are promoted, advertised or recognized as a KCTCS activity; 4. Are paid for through use of any KCTCS funds; or 5. Are sponsored by a Student Organization and held on KCTCS property. KCTCS Property: means any real property, buildings, and facilities under the primary control of KCTCS through ownership, lease, or other means. Permits: all applicable licenses and permits as required by Kentucky Revised Statutes and KCTCS policies and procedures. Student: means an individual enrolled in any course, program, or training administered by KCTCS. Visitor: Visitor means any person on KCTCS property who is neither an employee nor a student. KCTCS prohibits serving, selling, or using alcoholic beverages on KCTCS property and at KCTCS events and activities, except as specifically authorized by this policy. In accordance with Kentucky law, KCTCS prohibits any person under the age of 21 from consuming, possessing, or serving alcohol. Serving, selling, or using alcoholic beverages on KCTCS property and at KCTCS events shall be in compliance with all applicable Kentucky laws, local ordinances, and KCTCS policies. All KCTCS events where alcoholic beverages are served, sold, or used shall be approved in accordance with this policy. Service and Sales of Alcoholic Beverages - The KCTCS President or the applicable College Chancellor may authorize the serving or sale of alcoholic beverages on KCTCS property or at KCTCS events, provided that such use does not violate any law or KCTCS policy and meets all the requirements of this policy.
- KCTCS reserves the right, in its sole discretion, to terminate the service and/or sale of Alcoholic Beverages at any time during any event held on KCTCS Property.
- In addition, reservation of any facility is subject to approval of the KCTCS official responsible for the facility, and reservations are subject to KCTCS policies on facilities. If alcohol is approved for an event on KCTCS property, the applicable KCTCS official for the facility shall be informed and provided copies of the applicable permits.
- Approved events at which alcoholic beverages are served or sold shall meet the following requirements:
- Be a private event and not open to the public;
- Be an event for which tickets have been sold or invitation or membership is required
- Be held at a specifically designated and approved space; and
- Be an event where the majority of the attendees are age twenty-one (21) and above.
- Non-alcoholic beverages and food must also be provided at any event at which alcoholic beverages are served.
- The serving of alcoholic beverages at all approved events will be limited to a total of not more than five hours with termination of service of alcoholic beverages at least one hour prior to the end of the event.
- The sponsor shall indemnify KCTCS for any losses resulting from noncompliance with this policy.
- The sponsor of the event and the licensed, insured caterer shall take affirmative and appropriate steps to ensure that persons under the age of twenty-one (21) are not served alcohol.
- Serving, selling, or using alcoholic beverages at any official KCTCS event that is held at a personal residence or other off-campus private facility, shall comply with all aspects of this policy. Alcoholic beverages for any other use than instructional use in programs of study must be purchased with non-KCTCS funds.
- Promotions and advertisements for events shall not indicate that alcohol will be served or consumed.
- Visibly intoxicated and/or disorderly persons shall not be served or permitted to consume alcoholic beverages. KCTCS reserves the right to remove any guest of an event if the individual becomes disorderly or disruptive. This includes utilizing event security or local law enforcement.
- The KCTCS President or applicable College Chancellor or designee may require security measures or security personnel for an event.
Permits and Insurance To ensure compliance with Kentucky law and KCTCS administrative procedures, all events involving the possession, service, or consumption of alcoholic beverages on KCTCS property must adhere to the following insurance and permitting requirements: Permits - State and Local Permits:
The event sponsor must obtain all applicable permits from the Kentucky Alcoholic Beverage Control (ABC) Board as required under KRS Chapter 243. This includes but is not limited to temporary event permits, auctioning licenses, catering licenses, and any other ABC required permits depending on the nature of the event. - Submission of Documentation:
Copies of all ABC permits and any required local city or county permits must be submitted to the KCTCS President or applicable College Chancellor and retained by the college’s event or facility coordinator. - Sponsor Eligibility:
Sponsors must be individuals aged 21 or older or recognized organizations affiliated with the college. -
- Student organizations are prohibited from sponsoring events involving alcohol.
Insurance Requirements - Liability Coverage:
All external users or sponsors must provide a Certificate of Liability Insurance with coverage of at least $1,000,000 per occurrence / $3,000,000 aggregate, naming KCTCS and the hosting college as additional insured. Proof of coverage must be submitted 7 business days prior to the event. - Policy Duration:
The insurance policy must cover all dates during which the sponsor will use KCTCS property. - Exemptions:
Federal, state, or local government entities may be exempt from providing proof of liability insurance, subject to review. Alcohol Use in Programs of Study - Subject to approval by the College Chancellor, the use of alcohol is permitted for educational purposes that encompass Culinary Arts events and other related functions as determined by the College Chancellor.
- All alcoholic beverages kept on College property shall be stored in a secure location.
- Alcoholic beverages may be made available for consumption in certain classes under appropriate supervision. Class participants will be asked to present proof that they are of legal Kentucky drinking age and will be held responsible for limiting their consumption of alcohol to safe amounts.
- Alcohol for instructional use in programs of study may be purchased with institutional funds. In such instances, an employee may be required to make the purchase and seek reimbursement or to make arrangements for the invoice to be direct billed to the College. KCTCS System Office Procure to Pay is to be consulted prior to the purchase for the most efficient purchase method.
Alcoholic beverages for any other use than instructional use in programs of study must be purchased with non-KCTCS funds. All other requirements that are part of this policy must be followed. KCTCS President or applicable College Chancellor: Approval for any event involving alcohol must come from the KCTCS President for the System Office or applicable College Chancellor or designee. The person or organization wishing to sponsor an event under the provisions of this Policy must complete a “Request for Approval to Serve Alcoholic Beverages” form. The KCTCS President or applicable College Chancellor must grant written permission no less than seven (7) calendar days prior to the event. KCTCS Facilities Supervisor: The KCTCS facilities supervisor for the location of the event must receive a copy of the applicable forms and permits to ensure compliance with this policy prior to the event. The Associate Vice President for Facilities at the KCTCS System Office will be considered the facilities supervisor for the System Office space. Compliance with this policy is in accordance with Administrative Policy 1.1 - Policy on Policies. Any exceptions to this policy must be approved by the applicable System or College Chancellor or designee no later than twenty-four hours prior to the start of the event.
