1. Purpose

The purpose of this policy is to define and affirm the respective authorities and responsibilities of the Kentucky Community and Technical College System (KCTCS) Board of Regents and the President of KCTCS in accordance with Kentucky law. This policy establishes a clear governance framework that enables effective leadership, oversight, and administration of KCTCS while supporting the System’s mission, goals, and strategic objectives. It is intended to ensure accountability, operational efficiency, and sound decision‘making in the management of KCTCS affairs, while promoting transparency and consistency across the System.

2. Scope

The policy applies to the Kentucky Community and Technical College System Board of Regents and the KCTCS President.

3. Definitions

KCTCS Board of Regents - the governing body of the Kentucky Community and Technical College System responsible for board policy development, oversight, and ultimate authority for administration of the System in accordance with Kentucky law.

KCTCS President - the chief executive officer of the Kentucky Community and Technical College System, responsible for leading and managing the System under the authority and direction of the Board of Regents.

4. Policy Statement

Board of Regents Responsibilities

To accomplish the purposes and the goals set forth by the statutes of the Commonwealth of Kentucky, the Board of Regents of KCTCS has the exclusive authority and the responsibility to:
  • Delegate appropriate administrative, operational, and fiscal authority to the KCTCS President to carry out the daytoday management and efficient operation of the System, consistent with applicable law and Board policy.
  • Exercise governance authority over KCTCS, serving as a corporate body vested with the powers, rights, privileges, and immunities customarily held by governing boards of public educational institutions.
  • Adopt and enforce bylaws, rules, and regulations governing Board members, officers, agents, and employees.
  • Periodically evaluate institutional progress toward the System’s mission, goals, and objectives in alignment with the adopted strategic agenda, and hold officers and officials accountable for such progress.
  • Exercise exclusive authority over appointments, qualifications, salaries, compensation, promotions, and official employment relations of all KCTCS employees.
  • Acquire, hold, improve, and dispose of real property under KRS 164A.575.
  • Review, manage, and direct the disposition of assets, and pursuant to KRS 164A.575, sell or otherwise convey those assets determined to be unnecessary for carrying out the System’s mission and purposes.
  • Appoint, evaluate, and, when necessary, remove the KCTCS President in accordance with applicable law and Board policy.
  • Review and approve proposals for new accredited programs requiring dedicated general fund appropriations for capital or operating expenses beyond the System’s regular appropriations, in accordance with KRS 164.583(4)(a).
Upon recommendation of the KCTCS President, the Board shall:
  • Review the KCTCS biennial budget request;
  • Designate each College with a name;
  • Encourage and accept donations of land and funds to be used in the acquisition, construction, or operations of colleges in the system;
  • Accept federal grants when deemed appropriate to be used in the acquisition, construction, or operations of colleges in the system; and
Review budget planning and implementation processes to ensure consistency with the adopted strategic agenda and biennial budget and with the missions of the Colleges within the System. The responsibilities listed above are not intended to be exhaustive and do not limit the Board of Regents’ authority as provided by law or policy.

Responsibilities of the KCTCS President

To fulfill the responsibilities of the KCTCS Board of Regents, specific authority has been delegated to the KCTCS President to ensure the effective day-to-day management and strategic operation of the System. The authority of the KCTCS President includes but is not limited to, the following:
  • Supervise all administrative and managerial aspects of KCTCS operations, including personnel matters and fiscal management;
  • Oversee the System’s operational and facilities plans;
  • Establish partnerships with community members, local governments, and other entities to advance the mission of KCTCS;
  • Approve, modify, and discontinue academic and workforce programs, following input and recommendations from college faculty relating to curriculum and consultation with the Board of Regents;
  • Submit to the Board of Regents for review and approval any proposal to offer a new accredited program requiring dedicated general fund appropriations for capital or operating expenses beyond the System’s regular appropriations;
  • Review annual budget requests submitted by each College Chancellor for purposes of developing the KCTCS systemwide budget;
  • Review and approve the operational plan submitted by each College Chancellor; and
  • Promulgate and interpret administrative policies and procedures necessary to carry out the responsibilities of the office.
These authorities are not intended to be exhaustive and do not limit any additional powers or duties delegated to the President by law or Board or Regents policy.

5. Exceptions


The KCTCS Board of Regents may make exceptions to this policy where statute allows.
