1. Purpose

The purpose of this policy is to affirm the commitment of the Kentucky Community and Technical College System (KCTCS) to providing equal employment opportunity in all aspects of employment. This policy establishes a framework to ensure that all employment decisions are based on merit, qualifications, and legitimate business needs, and are made in compliance with applicable federal and state laws.
This policy is intended to promote a workplace environment free from unlawful discrimination and harassment, where all individuals are treated with dignity, fairness, and respect. It defines the responsibilities of management and employees in upholding equal employment opportunity principles, ensuring consistent and uniform application across the System.

2. Scope

This policy applies to the entire Kentucky Community and Technical College System.

3. Definitions

Management - Employees with supervisory authority over one or more employees, including responsibility for employment‘related decisions and for ensuring compliance with KCTCS policies and applicable law.

4. Policy Statement

KCTCS is an equal employment opportunity employer. Employment decisions are based on merit and business needs and are made in accordance with applicable federal and state law.

Equal employment opportunity notices are posted online and near employee gathering places as required by law. Additionally, they are posted on bulletin boards where employment opportunities are displayed and appropriate on-line communication systems. These notices summarize the rights of employees to equal opportunity in employment and list the names and addresses of the various government agencies that may be contacted in the event that any person believes he or she has been discriminated against.

It is the policy of KCTCS to comply with the Americans with Disabilities Act (ADA). KCTCS will not discriminate against any qualified employee or job applicant with respect to any terms, privileges, or conditions of employment because of a person's physical or mental disability. KCTCS will also make reasonable accommodation wherever necessary for all employees or applicants with disabilities, provided that the individual is otherwise qualified to safely perform the essential duties and assignments connected with the job and provided that any accommodations made do not impose an undue hardship on KCTCS.

While management is primarily responsible for seeing that KCTCS' equal employment opportunity policies are implemented, all employees share in the responsibility that their personal actions comply with the applicable policies.

Any employees, including immediate supervisors, involved in discriminatory practices will be subject to disciplinary action, including termination.

5. Exceptions

Exceptions to this policy can only be made in accordance with federal and state laws.
