I.  PURPOSE
 
To establish policy and procedures in the Los Angeles County Department of Mental Health (DMH/Department) for the disposition of clients' unwanted medications.
 
II. DEFINITIONS
 
No definitions are associated with this policy.
 
III.  POLICY
 
Under no circumstances shall directly operated clinic staff repossess or accept surrendered prescription drugs, both controlled substances and non-controlled drugs, or over-the-counter drugs from clients. Clinic staff shall direct the client to:
  • The closest year-round Drug Enforcement Administration Controlled Substance Public Disposal Locations
  • Any of the California State Board of Pharmacy Drug Take-back Locations
Under no circumstances shall DMH staff repossess or accept illicit drugs from clients.

Under no circumstances shall DMH staff dispose of illicit drugs for clients.

If Drug Take-back programs or locations are inaccessible to off-site clients and the medication is not listed on the United States Food and Drug Administration's Flush List, at the client’s request DMH staff may provide the client with a RxDestroyer medication drug deactivation and disposal system to dispose of their unwanted medications in the following manner:
  • Step 1. Take prescription or over-the-counter drugs out of their original containers
  • Step 2. Place prescription or over-the-counter drugs in the RxDestroyer container
  • Step 3. Close the container lid
  • Step 4. Conceal or remove any HIPAA information, including the prescription number, on the empty containers by covering it with a permanent marker or duct tape, or by scratching it off
  • Step 5. Place the sealed RxDestroyer container with the drug mixture and the empty drug containers in the trash
Estimated maximum allowable quantity of tablets or capsules for each RxDestroyer container:                     
  • 4 oz     ~ 30 tablets or capsules
  • 16 oz   ~ 300 tablets or capsules
