I. PURPOSE | To ensure the Los Angeles County Department of Mental Health (DMH/department) complies with Mental Health Service Act (MHSA) requirements for any issue resolution by addressing local issues related to Mental Health Service Act (MHSA), access to services, and MHSA requirements. | II. DEFINITIONS | No definitions are associated with this policy. | III. POLICY | The MHSA Issue Resolution Process (IRP) shall be developed in collaboration with various public mental health stakeholders. A DMH adopted MHSA IRP policy shall ensure that community members and stakeholders having issues, concerns, or grievances regarding activities of the MHSA provided within Los Angeles County shall be responded to in a sensitive, timely, appropriate, and culturally competent manner. The local issue resolution process shall be exhausted before accessing State venues such as the Mental Health Services Oversight and Accountability Commission (MHSOAC), Department Health Care Services (DHCS) or California Mental Health Planning Council (CMHPC) to seek issue resolution or to file a complaint or grievance. - Issues shall be addressed first at the County level through the MHSA IRP and decisions shall be consistent with MSHA statutes and regulations.
- DMH shall be committed to resolving issues related to the implementation and ongoing operations of its programs.
- The resolution of issues associated with MHSA-funded programs shall be part of the department’s overall issue resolution process.

- Inconsistencies between the approved MHSA Plan and implementation

- Violation of statute or regulations relating to use of MHSA funds

- The local MHSA Community Program Planning Process
- Supplantation
