Annual Notification of Rights to Inspect and Review Records

At the beginning of each school year, the School District will publish in the Student Rights and Responsibilities materials, a notice to parents, guardians, educational decisionmakers or eligible students of their rights under the Family Educational Rights and Privacy Act and this policy. This publication will be included with a packet of material provided parents/guardians or an eligible student when the student enrolls during the school year.

 

The notice will include the following:

  1. The rights of a student’s parents, guardians, educational decisionmakers or eligible students to inspect and review the student’s records,
  2. The right of a student’s parent, guardian, educational decisionmaker or an eligible student to seek to correct parts of the student’s records which he or she believes to be inaccurate, misleading or in violation of student rights and the right to a hearing if the District decides not to alter the records as requested,
  3. The right to not have personally-identifiable information contained in the student’s education records disclosed to others without the consent of the student’s parent, guardian, educational decisionmaker or of the eligible student, except to the extent that the Family Educational Rights and Privacy Act authorizes disclosure without consent, and
  4. The right of any person to file a complaint with the U.S. Department of Education concerning alleged failures of the Lincoln Public School District to comply with the Family Educational Rights and Privacy Act, and
  5. A notice of the information the district considers to be directory information and opt-out rights.

The District will make a reasonable effort to provide translations of this notice to non-English speaking parents, guardians or educational decisionmakers in their native language.
